Two documents. The first covers your use of Headland. The second, kept separate on purpose, covers your consent for us to collect your smart meter data. You agree to each one separately.
1. Headland terms of use
1.1 Who we are
Headland is provided by PFN Energies Limited, a company registered in England and Wales with company number 17198865, whose registered office is at Bleby House, Cheltenham, GL54 5LL. We are registered with the Information Commissioner’s Office under number ZC144445. You can contact us at hello@pfnenergies.co.uk.
1.2 What Headland is
Headland is a web application for businesses that brings together their energy meters, contracts, consumption data, carbon figures and market information. It is a business service and is not intended for domestic consumers.
1.3 Your account
You must be authorised to act for the organisation you set up on Headland. Access is by a sign-in link sent to your work email address; there are no passwords. Keep your email account secure, since anyone who can read it can open your Headland account. You may invite colleagues to your organisation and you are responsible for who you invite. Tell us promptly at the address above if you believe your account has been used without authority.
1.4 Your information
You confirm that the information you give us about your organisation, sites, meters and contracts is accurate and that you have the right to share it with us. You keep ownership of it. You give us a licence to store and process it in order to provide Headland to you, and to show it to colleagues you have invited.
1.5 What we provide, and what we do not
Headland shows figures calculated from data supplied by you, by your meters and by third-party sources such as suppliers, industry databases and market data providers. We take care over these calculations but we do not guarantee that they are complete or free of error, and third-party data may be delayed, estimated or revised. Market prices and commentary are provided for information. Nothing on Headland is advice to enter into, or not to enter into, any energy contract. PFN will never sign, accept or enter into any contract on your behalf, through Headland or otherwise. Every energy contract is agreed by you. Where PFN sources offers for you under your letter of authority, the decision whether to accept stays with you and the terms of that service are set out in the letter and in PFN’s standard terms of business.
1.6 Price
Headland is free. You will never be charged for using it unless you explicitly register for a paid plan at a future date, should one be introduced. We will not move you onto a paid plan, add a charge to your account or take any payment without that explicit registration. Signing a letter of authority creates no fee.
1.7 Acceptable use
You must not use Headland for anything unlawful, attempt to access another organisation’s data, interfere with the service or copy it in bulk, or load content you do not have the right to share.
1.8 Availability and changes
We aim to keep Headland available but do not promise uninterrupted access. We may change or withdraw features, and we may update these terms. For material changes we will email the account owner at least 30 days in advance; continuing to use Headland after that date is acceptance of the new terms.
1.9 Closing your account
You may close your organisation’s account at any time from Settings or by emailing us. We may suspend or close an account that breaks these terms. On closure we delete your organisation’s data within 90 days, except records we must keep by law or under the consent terms below, and withdraw any smart meter consents you hold through us.
1.10 Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, because Headland is provided free during early access, we are not liable for any loss of profit, revenue, savings or data, or for any indirect or consequential loss, arising from your use of Headland or reliance on anything shown in it, and our total liability to you in any 12-month period is limited to £100.
1.11 Privacy
How we handle personal data is set out in our privacy statement, which forms part of these terms.
1.12 Law
These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction.
SEPARATE CONSENT
2. Smart meter data consent terms
These terms apply only if you ask us to collect readings from your organisation’s smart meters. They are separate from the terms of use above and you agree to them by a separate action. You can use Headland without agreeing to them, but we will not be able to show half-hourly consumption, and the carbon and consumption features will rely on bills and meter readings instead.
2.1 Who is collecting your data
PFN Energies Limited, company number 17198865, Bleby House, Cheltenham, GL54 5LL. Our Data Protection Officer can be reached at hello@pfnenergies.co.uk or by post at the address above, marked “Data Protection Officer”. Use that address to ask what data we hold, to correct it, to withdraw consent or to complain. We answer within one month.
2.2 How the data is collected
n3rgy data service (https://n3rgy.com) is used by PFN Energies to interface with the national smart meter systems in order to collect, store, manage and share with PFN Energies your Smart Meter data. This service uses the Smart Energy Code (https://smartenergycodecompany.co.uk/) Party credentials and Party ID of N3RGY DATA LIMITED, incorporated and registered in England and Wales with the company number 11712674 whose registered office is at Prennau House Copse Walk, Pontprennau, Cardiff, Wales, CF23 8XH.
2.3 What we collect
Half-hourly electricity and gas consumption readings, and daily totals, from each smart meter you place in scope, from the date you tell us you took responsibility for the premises (the “move-in date”) onwards. We do not collect data from before that date.
Meter and device details needed to identify the meter: MPAN or MPRN, device identifiers, installation address and commissioning status, as returned by the smart meter network.
The evidence you provide to establish your authority: your signed letter of authority, a recent energy bill for each meter, and the name, position and email address of the signatory.
2.4 What we use it for
Showing consumption, cost, peak demand and out-of-hours use for your sites and meters in Headland.
Calculating Scope 1 and 2 carbon emissions and preparing SECR and carbon footprint reports for your organisation.
Sizing and pricing energy contracts and targets at your request.
Verifying your authority and keeping the records the Smart Energy Code requires.
We share the data with colleagues you invite to your organisation’s account, with n3rgy data ltd as the service that retrieves it, and with our hosting providers who process it on our instructions. We share it with energy suppliers only where you ask us to obtain prices or offers for you. We do not sell it or use it for marketing.
2.5 How long your consent lasts
Your consent lasts 24 months from the date you give it, or until the end date on your letter of authority if that is sooner. We will remind you by email after 12 months that we are collecting this data, and again shortly before it expires, when you can renew it by the same process. If it is not renewed we stop collecting on the expiry date.
2.6 Withdrawing consent
You can withdraw consent for any meter, or all of them, at any time: in Headland under Settings, by emailing hello@pfnenergies.co.uk, or directly with n3rgy through its consumer portal. Withdrawal is as simple as giving consent and takes effect from the time of your request. We record that time, tell n3rgy to stop collection within two working days of receiving your request, and confirm to you by email when it is done. Withdrawal removes our access to that meter’s past and future readings through the smart meter network. If your organisation leaves a premises, tell us: that counts as withdrawal for the meters there.
2.7 How long we keep the data
Consumption readings: for as long as your organisation has a Headland account and consent is in place, and for 12 months afterwards so that reports for past periods can still be produced, then deleted.
Consent evidence (letter of authority, bill, verification record and the n3rgy consent reference): four years after the consent ends, because the Smart Energy Code requires it to be available for audit. It is held in a store that cannot be altered and that only named PFN staff can read.
2.8 Your rights
You can ask for a copy of the data we hold, ask us to correct or delete it (subject to the audit retention above), and complain to the Information Commissioner’s Office at ico.org.uk. Our full privacy statement sets out how we handle personal data generally.
